Part 3: The Smoke and Mirrors of the Law

The county courthouse was a gray, neoclassical monolith that felt more like a fortress than a place of justice. The steps were swarming with local reporters; news of the "Respected Contractor's Secrets" had leaked to the press, drawing a circus of cameras and microphones.
Emma walked up the steps flanked by Victoria Vance and two plainclothes officers assigned for her protection. She wore a high-collared dark dress to hide her bruises, but her posture was unyielding.
Inside the courtroom, the air was thick with tension. Sitting at the defense table was Dean Carter. He was no longer wearing his blood-stained shirt; he was dressed in a pristine navy suit, his hair neatly combed, looking every bit the upstanding citizen his brother had manufactured him to be. Next to him sat Thomas Carter, a man with a face like carved granite, looking at Emma with cold, calculated malice.
"All rise!" the bailiff called out as Judge Harold Baxter took the bench. Baxter was an older man, notorious for his strict adherence to procedure and his conservative views on family law.
Thomas Carter stood up immediately, before the prosecution could even present the formal charges. "Your Honor, if I may. We are here today on a matter of a tragic misunderstanding. My client, a dedicated father and pillars of the construction community, was subjected to a targeted, emotionally driven setup by a spouse seeking an unfair advantage in a pending divorce negotiation."
A murmur ran through the gallery. Victoria Vance stood up, her voice cutting through the noise like a scalpel. "An unfair advantage, Your Honor? The victim suffered three fractured ribs, a concussion, and severe facial trauma. The police arrived during the commission of a violent felony. Furthermore, we have a clear, uninterrupted digital recording of the defendant admitting to financial fraud and threatening the victim's life."
Thomas smiled smoothly, turning toward the judge. "Ah, yes, the recording. A piece of audio obtained without consent, highly edited, and manipulated under extreme duress. We will be filing an immediate motion to suppress that audio on constitutional grounds. Additionally, we are requesting temporary emergency custody of the minor child, Lily Carter, as the mother's current psychological state and physical injuries render her incapable of providing a stable environment."
Emma’s breath caught in her throat. She gripped the edge of the table so hard her knuckles turned white. They were trying to take Lily today.
"Your Honor!" Victoria raised her voice, her eyes flashing with rare anger. "The child was found hiding in a laundry closet while her father and his associate were actively brutalizing her mother. To place that child back into the orbit of her abuser is not only a judicial travesty; it is a threat to her life."
Judge Baxter banged his gavel, his expression inscrutable. "Quiet in my court. I have reviewed the preliminary police reports. The criminal charges are severe enough to deny bail for Mr. Mercer, given his prior record. However, regarding Mr. Dean Carter… given his deep ties to the community and lack of prior convictions, I am setting bail at five hundred thousand dollars."
"Your Honor, no!" Emma gasped out loud, unable to contain her horror.

"Furthermore," Baxter continued, ignoring the outburst, "custody of the minor child will temporarily remain with the mother under a strict order of protection. The matter of the recording's admissibility will be handled at the evidentiary hearing in two weeks. Court is adjourned."
As the gavel fell, Thomas Carter turned back to look at Emma. He didn't say a word, but the smug, victorious smirk on his face told her everything. The battle hadn't even begun, and Dean was already going to be out on the streets.
